Welcome to Americus Estates Mobile Home Park! It is our desire that you and your family
enjoy living here and that you
will consider our community your home.
The following regulations are being furnished to you for the betterment of this community.
Compliance with all
rules and regulations is absolutely necessary. They are made for everyone’s protection and
safety. Your
cooperation is solicited.
An Eviction notice could be served on the first notice if we feel you or your guests are
endangering other people or destroying personal property, whether it belongs to the park or another individual.
Violence will not be tolerated by you or your guests. These rules and regulations may change
at any time without
notice.
PARK RULES & REGULATIONS
1. IT IS A REQUIREMENT OF THE PARK TO HAVE A WORKING SMOKE DETECTOR AND FIRE
ALARM IN YOUR HOME AT ALL TIMES. Please see the Park Manager for a fire alarm and
smoke detector if you need them.
2. The Park Speed Limit is 10 miles per hour. This will be strictly enforced. No joy riding
of motorcycles, 3-wheelers, 4-wheelers, dune buggies, mini bikes or any other off road vehicles etc., will be allowed in the Park. You are responsible for your friends or
relatives that are visiting the park. Violations will not be tolerated; this is a safety issue.
3. Pet Regulations
A. Only non-vicious pets are permitted in
the park. No pit bulls, dobermans, etc. allowed.
B. Pets must be under 30 pounds.
C. Do not ever allow pets to run loose
throughout the park. Pets must be kept on a leash or inside a fenced yard by day. By night all pets must be kept inside so they do not bark and annoy other residents.
D. Dangerous pets are not allowed. Guests
of the tenants who bring their pets into the park must comply with these same rules as residents. No vicious breeds are allowed and no pets are to be allowed to run loose.
4. Parents are responsible to see that children do not disturb neighbors or abuse property.
Not only will parents be held financially responsible for damage caused by their children to private park property, but also such damage or unruly behavior will subject Resident to eviction.
5. The lot and mobile home are single-family dwelling units & must be kept neat &
clean in appearance. Tenant is responsible for keeping lot clean and free of debris, trash, toys, non-working automobiles, etc.
A. No combustible or hazardous debris or other items are
allowed.
B. No unsightly clutter.
C. A storage building is required within 30 Days if you are going
to leave personal items or equipment outside. You are welcome to purchase your own storage shed.
D. Major auto repairs & ‘junkers’ are not allowed. All
automobiles must be in good working condition and used regularly. Non-working or unused automobiles are not allowed to be stored at Americus Estates.
E. Trash must be taken care of weekly.
F. It is your responsibility to carry insurance on your personal
belongings and to have fire and other damage insurance on your home.
6. Payments, Fees & Notices:
A. Rent is due on, or before the 1st of the month.
B. There will be a Late Fee Charge of $50.00 if not paid on or
before the 5th of the month. No exceptions, so please don’t ask. If payment is not received on or before the 11th you will be evicted on the 12th. Should this occur, all money paid or improvements
made will be forfeited.
Note: Any expenses incurred to secure possession will be added to your
account and your lot rent will not be considered paid until any and all fees have been paid.
C. We charge a fee of $35.00 for returned checks. Note: If you pay by check,
your payment is not considered paid until the check posts.
D. After your lease is up, it becomes a month-to-month lease. A one-month-notice is
required before moving out of the park or you will be charged for and have to pay for a full month after you leave without notice.
7. If you own your own mobile home, additional buildings or adding on rooms to your existing
mobile home are only permitted with written approval from management. Storage Buildings are required if your personal items or equipment are going to be left outside. Contact office for a specific
location on your lot.
8. Vehicles, Trailers and/or Boats
A. Vehicles are to be parked near your homes.
B. Trailers and/or Boats are not to be parked in the road, or on the
lot.
C. Loud vehicles are to be repaired with proper mufflers or whatever
other equipment is required to quiet them.
D. Loud music is not to be played from cars either.
9. No subletting of mobile homes or lots without written approval by management. If
approval is given, each prospective tenant must fill out an application (the same as any other prospective tenant) that must be approved prior to moving into the park. The original tenant is liable
for the actions of any sublet tenants including payments that must be made. The original tenant can be evicted due to the actions of the sublet tenant or their guests.
10. You are responsible for the actions of any and all persons you allow onto the premises.
Americus Estates reserves the right to refuse admittance to any non-residents if they violate these rules.
11. We will evict and not tolerate tenants, occupants, or their guests who engage in
conduct that will disturb the quiet and peaceful enjoyment of the premises by other tenants. Tenants, occupants, or guests who engage in criminal activity that threatens the health, safety, or right
of peaceful enjoyment of the premises or anyone that is a danger to the other tenants or to the premises will be evicted. Nor will we tolerate any drug-related criminal activity on or near the
premises. You are responsible for your occupants and guests.
12. If and when you move a mobile home into or out of Americus Estates you must first
coordinate with our manager. All movers must be insured, and Americus Estates must be named as an ‘additional insured’ in the event damage is caused by the move. The manager must be given a copy of
the moving permit, and the lot must be left clean of any trash, tires, etc.; decks and anchors are also to be removed unless prior arrangements are made with the manager.

Lease Terms:
- Payment of the monthly lease is due by the first day of the month.
- Payment may be in the form of cashier's check, money order, or personal check. A fee of $25.00 will be charged to the lessee for each check that
is returned for insufficient funds.
- The payment is considered late if it is received after the fifth day of the current month. A $50.00 charge will be added to the balance due
after the 5th of the month.
- A $5.00 charge will be added each subsequent day until the payment is made up until twenty days into the current month. At that time the
eviction proceeding will begin. This could include the elimination of water service and the disconnection of the electrical service.
- The balance will not be considered "paid in full" until all fees due have been paid. A partial payment is still subject to penalties
until it is paid in full. A $40.00 reconnection fee will be charged in the event that water and/or electrical service has been disconnected by management.

General Rules
- Although management is responsible for maintaining the common areas, the tenant is responsible for the landscaping maintenance of their respective
space.
- Grass areas shall be kept trimmed and edged. This includes the areas behind, beside, and under homes and against perimeter fences.
Residents who do not maintain their spaces will face disciplinary action that may include a fine of up to $40.00 per month.
- Management must approve any changes or alteration of the space and/or landscaping. The tenant is responsible for maintaining any changes to the
landscaping.
- All plants, trees or other planted or otherwise permanent fixtures placed at a space by a lessor become property of the park in the event the lessee
moves.
- The tenant understands that management is not responsible for any damage to the property or homes of a tenant as a result of an act of nature.
- Management reserves the right to access each space whether or not tenant occupied, to conduct inspections or to maintain utilities.
- Management is responsible for providing water and sewer and gas (if applicable) and electric up to the point of connection of the mobile home.
The resident is responsible for all maintenance from that point of connection to the mobile home. In addition, resident is required to heat tape and insulate all exposed water lines, meter
pits, and meters. Should there be a break due to the heat tape not functioning then the resident is responsible for the cost of replacement.
- All structures and/or additions to either the mobile home or the space must be pre-approved by management prior to their installation.
Management reserves the right to demand the repair and maintenance of any structure and/or addition if management feels that there is an unsafe and/or unsightly conditions.
- Storage units must be approved by management and shall remain the property of resident. Management is not responsible for any losses or damage
to tenant's shed or stored items.
- Large patios and porches require skirting. All homes require skirting. Patios and porches are not acceptable storage locations.
- Inoperative vehicles, boats, unattached trailers, or commercial vehicles are not permitted on the streets or in or around
tenant's spaces.
- State law prohibits the storage of old furniture, lumber, refuse, salvaged materials, automotive parts, and other materials in or around your
spaces. The dismantling of any motor vehicle in the park is prohibited.
- No more than two vehicles are permitted per space. Vehicles shall be parked on the parking spaces assigned to the respective home site whenever
possible, if applicable. Other vehicle parking requires management approval. Tenants shall not park their vehicles in vacant or otherwise unused spaces of other residents.
- Only operative vehicles licensed for the highway are permitted within the park. The speed limit shall not exceed what is safe and prudent for
the conditions. Off-road vehicles shall not be driven within the community.
- Residents should park as close to the curb as possible to permit access of emergency vehicles when necessary.
- Domestic pets under 15 pounds are permitted within the park. All other pets must be approved by
management. Pets must be kept inside the home, within a properly secured fenced yard, or on a leash at all times. No more than 1 pet per household will be allowed.
The following breeds of dogs are not allowed within the park: Pitbull, Bulldog, German Shepherds, Rottweiler, Dobermans, Pythons, etc. Other aggressive breeds not
specifically named on this list are also prohibited. Any dogs with histories of aggression also are banned.
- Tenants are responsible for their pets at all times. Pets are not permitted to be unattended in the park and/or create any nuisance.
- Tenants are responsible for the activities of their children and their children's guests while they are in the park. An adult must supervise
young children at all times. Children are not permitted to play in the street, parking areas, or neighbor's yards without permission. Any damage caused by children
or guests to tenants mobile homes, vacant mobile homes or any part of the park will be charged directly back to offending parties/lessee.
- Children's toys are not to be left in the common areas when not in use. Children under 18 years of age are not permitted to be out and
unsupervised in the park after 10:00 pm.
- Disturbing noise is not permitted in the park at any time.
- No signs are permitted except with the permission of management.
- Commercial activities by residents and/or their guest are not permitted within the park.
- All federal, state, local laws, regulations and ordinances shall be obeyed by residents and guests of the park at all times.
- Violations of any of the above rules and regulations will result in the termination of the lease and the eviction of the tenants.
Management reserves the right to add to or alter these rules and regulations as circumstances require and as necessary for the safety and care of the community and for
securing the comfort, peace, and quiet convenience of all residents. The tenants and residents will observe and comply with all such rules as the management may prescribe on written notice to
residents. The failure by management to enforce any rule or regulation of the park or the failure to insist in any instance on strict performance of any requirement herein, shall not be
construed as a waiver of these rules and regulations. The provisions of these rules and regulations shall be severable; if any provision is held invalid or unenforceable by any court or law for
any reason whatsoever, the remaining provisions shall not be affected and shall be in full force and effect. These rules will be enforced by management to insure the health, safety, welfare,
comfort, peace, and quiet convenience of each resident in the park. Any resident who violates these rules and regulations will have their lease cancelled and will be evicted from the park.
Tenant acknowledges having read and understands all the stated rules and regulations and hereby agrees to comply with each and is in full agreement
with these guidelines being an integral part of the Security Deposit Agreement, and Lease between the tenant and management. Tenant acknowledges receipt of a copy of these community guidelines
for tenant's personal records. Tenant acknowledges that violations, breach or default of these guidelines, whether singular or several, will be grounds for termination of the tenant's lease and
will result in eviction from the park upon three days notice of such violation, breach, or default given by management.
